These Terms of Service (“Terms”) constitute a legally binding agreement between you (“User,” “you,” or “your”) and Kangaroo LLC, a Wisconsin limited liability company (“Kangaroo,” “we,” “us,” or “our”), governing your access to and use of the Kangaroo mobile application (the “App”). By creating an account or using the App, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree, do not use the App.
Age Requirement: You must be at least 18 years of age to create an account and use Kangaroo. By using the App and its payment features, you represent and warrant that you are at least 18 years old. If you misrepresent your age, you are responsible for any consequences that result.
University Email Verification: Access to the App is restricted to users with a valid email address from a supported university. Currently supported domains are @cornell.edu, @ucsb.edu, and @smu.edu. Kangaroo does not guarantee that every user with a supported email address is a currently enrolled student, and possession of a university email does not constitute verification of student status.
Account Restrictions: You may only create one account. Accounts are non-transferable. Kangaroo reserves the right to refuse service or restrict access at its sole discretion.
When you create an account, you agree to provide accurate and complete information, including your real name. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account.
Your username must be unique within your university and may only contain letters, numbers, periods, and underscores (3–20 characters). Kangaroo reserves the right to require you to change your username if it violates these Terms or is deemed inappropriate.
Profile information you provide—including your name, bio, school, dorm, location, and gender—may be visible to other users at your university. You may select “Prefer not to answer” for gender.
Kangaroo is a peer-to-peer platform that connects university students for three types of transactions:
Kangaroo is a platform only. We facilitate connections and process payments but do not employ, endorse, or supervise any user. We are not a party to any transaction between users and make no representations about the quality, safety, legality, or suitability of any listing, service, or item.
You agree to use Kangaroo lawfully and respectfully. The following conduct is prohibited:
Violations may result in warnings, posting restrictions, suspension, or permanent account termination at Kangaroo’s sole discretion.
Kangaroo prohibits any use of the platform that violates university academic integrity policies. You may not use Kangaroo to hire others for contract cheating, including but not limited to: taking exams, writing papers or essays, completing homework assignments, or any other form of academic dishonesty.
Listings that appear to facilitate academic dishonesty may be removed without notice, and accounts involved may be restricted or terminated.
The following items and services may not be listed, sold, or exchanged on Kangaroo:
Kangaroo reserves the right to remove any listing and restrict any account that violates these prohibitions.
All payments on Kangaroo are processed through Stripe, Inc. (“Stripe”). By using Kangaroo’s payment features, you agree to be bound by the Stripe Connected Account Agreement, which includes the Stripe Terms of Service (collectively, the “Stripe Services Agreement”). By facilitating a transaction, you authorize Kangaroo to share your information and transaction data with Stripe for the purposes of processing payments and managing your account.
Kangaroo charges a service fee on transactions to cover platform maintenance, payment processing, and operational costs. The applicable fee is displayed before you confirm any transaction. Fee rates may vary by listing type and are subject to change. Kangaroo will provide notice of material fee changes within the App. Service fees are non-refundable except in cases where a dispute is resolved in your favor.
Certain transactions may involve additional charges beyond the base listing price:
To receive payouts, you must complete Stripe Connect onboarding, which requires providing personal information including your legal name, date of birth, address, and bank account details to Stripe. This information is processed by Stripe in accordance with the Stripe Privacy Policy.
Withdrawals from your Kangaroo earnings require a minimum of $5.00. Payout timing is subject to Stripe’s standard processing schedule. Kangaroo does not guarantee specific payout timelines.
By saving a payment method to your account, you authorize Kangaroo to charge that payment method for transactions you initiate or accept, including base prices, service fees, receipt reimbursements, delivery fees, and lost/damaged fees. You may be asked to confirm charges via biometric authentication (Face ID or Touch ID) or device passcode depending on your settings.
Users may negotiate the price of a listing before accepting it. Negotiations take place within the App and are subject to the following rules: for Requests, the proposed price may not be lower than the listed price; for Offers and Marketplace items, the proposed price may not exceed the listed price. Once a negotiated price is accepted by both parties and the transaction begins, the agreed-upon price is binding.
Certain Requests (category: Borrowing) and Offers (category: Lending) involve the temporary exchange of physical items. The following terms apply:
Kangaroo facilitates cost-sharing between users for ride-related Offers. Kangaroo is not a transportation company and does not provide commercial transportation services. Users offering rides represent and warrant that they possess a valid driver’s license and active personal auto insurance that covers passengers. Kangaroo does not perform background checks, vehicle inspections, or verify insurance coverage. Users participate in rides entirely at their own risk.
Users who accept errands or delivery tasks do so as independent individuals, not as employees or agents of Kangaroo. Kangaroo is not responsible for the timeliness, accuracy, or quality of any errand or delivery.
Transactions may be cancelled under the following conditions:
Refunds for cancelled transactions are processed within 5–10 business days, depending on your payment provider.
All listings have an expiration time set by the creator. Expired listings are automatically removed from the feed. Users may also pause or delete their own listings at any time.
Kangaroo reserves the right to remove any listing that violates these Terms, contains prohibited content, or is otherwise deemed inappropriate, without prior notice.
Listings may be targeted by audience (e.g., dorm, school, location, or gender). Audience targeting is intended for relevance and user comfort. Kangaroo reserves the right to remove listings that use targeting features to discriminate against protected classes.
If you have an issue with a transaction, you may file a dispute through the App. The other party will have an opportunity to respond. Kangaroo administration will review the dispute and make a determination. Possible outcomes include: full refund to the payer, release of payment to the earner, a split of the disputed amount, or no action.
All decisions made by Kangaroo administration regarding disputes are final and binding. Kangaroo serves as the sole and final arbiter of all transaction disputes within the platform.
Users may report other users or content for harassment, spam, inappropriate content, scam or fraud, safety concerns, or other violations. Users may also block other users, which prevents all future interaction between the parties. Reports are reviewed by Kangaroo administration, which may take action including warnings, restrictions, or account termination.
Kangaroo may impose restrictions on your account at its sole discretion. Restrictions may include, but are not limited to:
Restrictions may be time-limited or permanent. You may request a review of any restriction through the App. Kangaroo’s determination on restriction reviews is final.
You may delete your account at any time through the App’s Settings. Account deletion is subject to the following conditions:
Account deletion is permanent and cannot be undone.
The App, including its design, code, logos, trademarks, and content created by Kangaroo, is the property of Kangaroo LLC and is protected by applicable intellectual property laws. You may not copy, modify, distribute, or create derivative works from any part of the App without our prior written consent.
You retain ownership of content you create and post on Kangaroo (listings, messages, images, reviews). However, by posting content on the App, you grant Kangaroo a non-exclusive, worldwide, royalty-free, transferable license to use, display, reproduce, and distribute your content solely for the purpose of operating and providing the App. This license terminates when your content is deleted or your account is removed, except for anonymized records retained per Section 16.
KANGAROO IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, KANGAROO LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:
IN NO EVENT SHALL KANGAROO LLC’S TOTAL LIABILITY TO YOU EXCEED THE GREATER OF (A) THE AMOUNT OF FEES PAID BY YOU TO KANGAROO IN THE TWELVE (12) MONTHS PRIOR TO THE CLAIM, OR (B) ONE HUNDRED DOLLARS ($100).
You agree to indemnify, defend, and hold harmless Kangaroo LLC, its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising out of or in any way connected with: (a) your use of the App; (b) your violation of these Terms; (c) your violation of any applicable law or regulation; or (d) your content or transactions with other users.
Before initiating any formal dispute, you agree to first contact Kangaroo at support@collegekangaroo.com and attempt to resolve the dispute informally for at least 30 days.
If the dispute cannot be resolved informally, all disputes arising out of or relating to these Terms or the use of the App shall be resolved through binding individual arbitration, conducted in the State of Wisconsin, in accordance with the rules of a mutually agreed-upon arbitration provider. If the parties cannot agree on a provider, arbitration shall proceed under the rules of the American Arbitration Association (AAA).
YOU AND KANGAROO LLC AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS, CONSOLIDATED, OR REPRESENTATIVE PROCEEDING. You expressly waive any right to participate in a class action lawsuit or class-wide arbitration.
Either party may bring an individual action in small claims court for disputes within the court’s jurisdictional limits.
These Terms shall be governed by and construed in accordance with the laws of the State of Wisconsin, without regard to its conflict of law provisions.
Kangaroo reserves the right to modify these Terms at any time. We will notify you of material changes through the App or by other reasonable means. Your continued use of the App after the effective date of any changes constitutes your acceptance of the updated Terms. If you do not agree with any changes, you must stop using the App and delete your account.
